The court overturned a lower court’s anti-trust ruling which had awarded US$79m to Ross-Simmons Hardwood Lumber Company.

Ross-Simmons, which was forced to close in 2001, had argued that Weyerhaeuser had monopolised alder sawlog purchases in the Pacific Northwest and used its purchasing power to keep sawlog prices higher than competitors could afford,

The Supreme Court ruling said Ross-Simmons’ “predatory-bidding theory of liability” could not support the jury’s verdict.
