Neither company would disclose the type of product involved in the case, with Rowlinson Garden Products saying only that the dispute arose “in respect of [its] registered and unregistered design rights”.
After proceedings were issued against Forest Garden, the latter agreed to take the product off the market and to make the payment to Rowlinson. The latter would not reveal the amount paid.
A statement from Rowlinson said that the company “invests a significant amount of time and resource in new product development and bringing new products to market and believes it extremely important that [it] protects this investment and [its] intellectual property rights.”
A spokesperson for Forest Garden said: “Forest has always been associated with innovation and we remain committed to bringing exciting new concepts to the market.”
